Everything. This cannot be done without constitutional amendment.
This boils down to a strong desire to takeaway Constitutional rights, if the government decides, on a whim, to investigate a person. How much closer to Soviet police state, NAZI police state, or any other authoritarian police state, do we need to get before the people wake up and realize these politicians are not looking after your interests. They want to lock up anyone who disagrees with them.
The idea that the FBI did everything it could is silly. We are hearing many stories from co workers, ex-wife, and others that he was talking, and acting like a potential terrorist. How many of these people were interviewed? What type of interview? How aggressively?
The FBI more likely did the minimum necessary to clear the file from the agents desk, and moved to the next file. Perhaps we need to deepen and broaden the investigations of people like this who come up repeatedly as a terror concern.
Instead we have legislators salivating at the idea of simply wholesale elimination of Constitutional rights on government whim. We used to call this tyranny.

They do that now, give them the right to take your rights and they will do it as often as they can. This is the road to serfdom.
Incentives matter, and incentivizing the federal government this way will destroy the Republic, and turn us all into serfs.
